Finally, the sentencing guidelines have been updated with regards to Gross Negligence Manslaughter. For far too long it was thought that fatalities caused by the negligence of individuals were not given sufficient importance when it came to sentencing.
From the 1st November, new guidelines will specify sentences that range from 1 to 18 years. The most severe will be for offences caused by a blatant disregard for rules or motivated by financial gain or avoidance of cost.
As per the current sentencing guidelines, mitigating and aggravating factors will be used to extend or reduce sentence time.
Although rare it is thought that they will influence the sentencing of an increased number of sole operators and one-man bands.
